On May 16, 2025, a Montana court paused one of the most extreme anti-trans bathroom bans in the country in response to our lawsuit. Because of this ruling, Montanans can use public facilities that align with their gender identity while our case proceeds.
We filed this case with the ACLU of Montana and the ACLU when the bathroom ban was signed into law. Soon after, a district court issued an emergency restraining order that stopped the law from going into effect. That was an important first step, but it only provided relief for a short time.
Friday’s ruling gives us a longer-term win. The court has issued a preliminary injunction that blocks the state from enforcing the law through the remainder of the case.
We’re relieved and encouraged by this decision. The court recognized what we’ve known all along: bathroom bans are rooted in fear and discrimination, not safety.
